The Moondrop Entertainment, LLC privacy policy (“Privacy Policy” or “Policy”) was last modified on Sep 25, 2024 and was first published and effective November 16, 2012. In this Policy, Moondrop Entertainment, LLC will be referred to as “Moondrop”, “our”, “us” or “we.”

We are providing this Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of information on our Service. The term “Service” as used herein refers to the following products and services offered by Moondrop: Drawp for School mobile application, Drawp for School web-based application available at app.drawpforschool.com/, and the Drawp for School website available at www.drawpforschool.com (the “Site”).

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. If you do not agree with our policies and practices, your choice is to not use of Service. By accessing or using the Service, you agree to this Privacy Policy.

We may update this privacy statement to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Service prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. If you continue to use this Service and the Service after the date the changes become effective, you will be deemed to have accepted those changes.

This Service is intended for children under 13 years of age and is intended to be used by pre-kindergarten and K-12 students. In order for a child to use the Service, Moondrop collects consent from the parent or guardian of a child directly or through the school that the child attends at the time the account is created. Student accounts are controlled by the school and/or teachers employed by the school that the student attends and have the ability to manage the student accounts. Personal Information for children under 13 years of age is not publicly displayed in connection with the Service.

CHANGES TO THIS PRIVACY POLICY

We will post any changes we make to this Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the home page of our websites, through the Service, or through another notification method that is designed to give you a clear disclosure that changes have been made to this Privacy Policy. The date the Privacy Policy was last revised is identified at the top of the page.

If we make material changes to how we use Personal Information collected from children under age 13, we will notify parents or guardians by email in order to obtain verifiable parental or guardian consent for the new uses of the child’s Personal Information. If you are under 13 and using our Drawp for School application, we will obtain verifiable parental or guardian consent directly from the school.

INFORMATION MOONDROP COLLECTS AND HOW IT IS USED

We collect several types of information from and about users of our Service, including information:

  • That may allow you to be identified, such as your name or your parent’s or guardian’s name, your child’s name, gender, profile photo, free-form biography, location or hometown, email address, or your parent’s or guardian’s email address;
  • Information about your internet connection, internet service provider, the type of computer or mobile device you use to access the Services, operating system, and IP address.

We collect this information:

  • Directly from you when you provided it to us, such as when you create an account or activate an account that was created for you or you use certain aspects of our Service (such as entering an email address on a form to send an email from your or your child’s Service account).
  • Automatically as you use the Service. Information collected automatically may include usage details, IP addresses, and information collected through cookies, log data, and other technological collection methods.
  • From third parties, such as your school when your school creates an account for you or interacts with you through your use of the Service.

Moondrop only collects as much information as is necessary to provide the Service to you and as needed by Moondrop to maintain the integrity of our Service, improve the Service that we offer to you, protect Moondrop and the users of the Service, to exercise our legal rights and obligations, and to otherwise take the actions that you request from us. To the extent any information is collected through automated technologies, that information is used only for analyzing the performance of and improving the Service and all access to any Personal Information is restricted only to Moondrop.

Information You Provide to Us

When you register with us through the Service to become a registered user, we will ask you for certain information about you that can be used to contact or identify you (“Personal Information”). Personal Information may include, but is not limited to, your name or your parent’s or guardian’s name, your child’s name, gender, profile photo, free-form biography, location/hometown, website, and email address or parent’s or guardian’s email address.

We use your Personal Information (in some cases, in conjunction with your “Non-Identifying Information,” see below) to provide the Service to you. For example, we create your user account for your use of the Service based upon the Personal Information you provide.

If you are over 13, we may use your Personal Information to contact you with information and updates about the Service. We use your Personal Information to respond to your questions and/or inquiries. If you no longer wish to receive these types of communications, you may opt-out at any time by following the link located at the bottom of each communication or by emailing us at support@moondropapps.com.

As part of the Drawp for School mobile and web applications, only teachers are permitted to send e-mail messages without restrictions. Student users of the Drawp for School mobile and web applications have the option to send e-mails from the Drawp for School mobile and web applications but only to e-mail addresses added by the teacher that controls the respective student accounts.

Users of the Drawp for School mobile and web applications also have the ability to record or upload audio files and share those with other users on the Drawp for School mobile and web applications, but only to other user accounts that have been added by the teacher that controls the respective student accounts. This may include other children under the age of 13, the teacher, school administrators, and parents of the children. We ask for access to your microphone in order to allow you to record these audio files. You are not required to grant access to your microphone, but if you refuse to do so, you will not be able to record audio files from directly within the Drawp for School mobile and web application and will be required to upload a separately recorded audio file in order to use this feature.

When you contact us through one of the contact forms made available on the Site, we collect the information you provide in connection with that form including your name, email address, school and district information, role, and phone number. We use this information to respond to your requests for more information about the Drawp for School mobile and web applications.

We also collect other information that you provide as part of registration and operation of the Drawp for School mobile and web applications that cannot reasonably be used to identify or contact you (for example, without limitation, age and individual preferences) (“Non-Identifying Information”).

When you download the Drawp for School mobile application from a mobile application stores (such as the Apple App Store or Google Play Store), we receive aggregated location-based information about the locations from which users are downloading the Drawp for School mobile application, but that data cannot be used to identify any individual specifically. Except as described in the “Information We Collect Through Automatic Data Collection Technologies” section below, we do not ask you for, access, or track any location-based information from your mobile device at any time while you are using the Drawp for School mobile and web applications.

When you use the Drawp for School mobile and web application we ask for access to your camera, photos, and microphone so that you may save your drawings or import a photo from your phone in order to work on it within the Drawp for School mobile and web applications. We ask for access to your microphone in order to allow you to add a personal message to your drawing. You are not required to grant access to your camera, photos, or microphone, but if you refuse to do so, you may not be able to use all of the features of the Drawp for School mobile and web applications.

Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be personally identified or contacted. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other Non-Identifying Information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Moondrop users to attempt to provide you with a better experience, to improve the quality and value of the Service and to analyze and understand how our Service is used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.

Moondrop does not collect biometric or health information, behavioral data, or sensitive data (as that term is defined under applicable laws, rules, and regulations).

Information We Collect Through Automatic Data Collection Technologies

When you download and/or use our Service, we may use automatic data collection technologies to collect certain information about the type of device you use, operating system, IP address, a browser type. We use this information so that we are able to provide you with the correct version of the Drawp for School mobile application and so that we may track how many users are on each operating system for the purpose of maintaining and improving the Service and its compatibility with different devices and operating systems.

Our Drawp for School mobile application allows users to access and use the Service from mobile devices. We will receive information about your mobile device model, software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Drawp for School mobile application.

When you visit the Service, our servers automatically record information that you inputted (“Log Data”). This Log Data may include information such as IP addresses, browser type, operating system, the time spent on using the Service, information you posted on our Service, items sent to others, your preferences, access times and dates, and other statistics. We use this information to monitor and analyze use of the Service and the Service’s technical administration, to increase our Service’s functionality and user friendliness, and to better tailor our Service to our users’ needs. We do not link this automatically collected data to other information we collect about you.

Automatically collected data is not shared with third parties for advertising or other direct marketing purposes at any time. Moondrop also does not use the information it is provided by you or collects through automated collection technology for behavioral, targeted, or direct marketing and does not display ads to users within the Service. We do not create any profiles about you based on the information that you provide or that is collected by us through any means for the purposes of targeted advertisements on third-party websites or services.

Like many online services, Moondrop and our partners use technologies such as cookies, beacons, tags and scripts on our Service to collect information. These technologies are used in saving login information for future logins to the Service, enable certain features of the Service, better understand how you interact with the Service, monitor aggregate usage by Moondrop users. They may also be used to analyze trends, and track users’ movements around the Site to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

MOBILE ANALYTICS

We use mobile analytics software to allow us to better understand the functionality of our Drawp for School mobile application on your device. This software may record information such as how often you use the Drawp for School mobile application, the events that occur within the Drawp for School mobile application, aggregated usage, performance data, and where the Drawp for School mobile application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile app.

INFORMATION ABOUT YOU PROVIDED TO US BY THIRD PARTIES

When your school creates an account for you or interacts with you through your use of the Service, we collect the same kinds of Personal Information as described in the “Information You Provide to Us” section above. Student accounts for our Drawp for School Google Slides add-on are created only after administrators approve the installation and access to the required permissions. Your school will obtain consent from you or your parents or legal guardians, who will be asked to approve use of this add-on, before any Google Slides add-on account will be created for you.

SECURE STORAGE

Moondrop’s cloud storage Service is provided through AWS, DigitalOcean, and Heroku, three of the world’s largest cloud storage providers which utilize the highest level of security measures available to protect all data and materials stored in the users’ accounts. We do not link the information we store in cookies to any other personal information other than your login information.

We use Local Storage Objects (LSOs) such as HTML5 to store content information and preferences. Third parties with whom we partner to provide certain features on our Site use LSOs such as HTML5 to collect and store information. These third parties are only permitted to use any personal information associated with LSOs to perform the tasks we hire them to do, in the ways we allow them to, such as performing analytics about the use of the Services. Our third-party partners are not permitted to sell or share your personal information except as explicitly described in this Privacy Policy. You may be able to change settings in your device or browser to reject local storage or local shared objects, or to remove any that have been downloaded to your device. Some parts of our Service may be more difficult to use or may not work at all if local storage or local shared objects are rejected.

MOONDROP’S SHARING OF YOUR INFORMATION

We do not sell your personal information to third parties except as disclosed in this Privacy Policy. Parents or guardians are able to consent to our use of their child’s personal information without having to also consent to our disclosure of their child’s Personal Information to third parties as we do not share this type of information with third parties. Personal Information for children under 13 years of age is not publicly displayed in connection with the Service.

When you register through the Service and submit Personal Information to create a profile, other Moondrop users may see your first and last name, as you entered them when signing up. If you choose to provide additional Personal Information in your profile, Moondrop users may see such additional Personal Information, including, but not limited to, your photo and email address. The Service is designed to allow for collaboration between students and teachers, so some sharing of Personal Information is required to fulfill those purposes. Teachers will be able to view all social interactions between students, including children under 13 years of age, however, those interactions are not and cannot be moderated by Moondrop as they occur. Moondrop does not and cannot endeavor to review every message sent between users of the Service before those messages are visible to other permitted users.

Personal Information from teachers is displayed publicly only if the teacher chooses to publish their lesson plans publicly, but that public publication is not required to use the Service. If the teacher does choose to publish their lesson plans publicly, the teacher’s first and last name and photo will be linked to the published lesson plan.

Content that is exposed publicly is moderated by Moondrop employees and must be approved before it becomes publicly visible to ensure that the Personal Information of children under 13 years of age is not inadvertently exposed.

We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain your Personal Information.

We may employ third party service providers to facilitate our Service, to provide the Service on our behalf, to perform Service-related services (such as maintenance services, database management, for video management, customer support, web analytics and improvement of the Service’s features) or to assist us in analyzing how our Service is used. These third party service providers may have access to your Personal Information but only for the purpose of performing these tasks on our behalf and are strictly obligated not to disclose or use it for any other purpose. To the extent any third-party service provider do have access to your Personal Information, they will be restricted so that they only have access to as much Personal Information as is required for them to perform their obligations. No third-party service provider is permitted to retain any Personal Information following the completion of their services to Moondrop.

We can disclose any information about you as required by law, to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process including, but not limited to, subpoenas, to protect the property and rights of Moondrop or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email and/or prominent notice on our Service of any change in ownership or uses of yours or your child’s personal information, as well as any choices you may have regarding your personal information.

We are not responsible for the privacy practices of such other services. We do not exercise control over third party websites and online services, and these third parties may place their own cookies or other files on your computer and collect data or solicit Personal Information and Non-Identifying Information from you. Other sites and online services follow different rules regarding the collection, use and/or disclosure of Personal Information and Non-Identifying Information.

This privacy policy applies to information collected by our site and our mobile applications only.

EXTERNAL STORAGE

Users can access Dropbox, Google Drive, and OneDrive to store content created with the Drawp for School mobile and web applications, or import compatible content into the Drawp for School mobile and web applications. These services authenticate the users directly, and an authentication token identifying the user is stored in the local browser session profile. This information is automatically discarded once the user closes the current browser session.

CONTACT FORMS

Users can submit requests for information to us through the contact forms made available on our Site, which are operated by Zoho Forms. Zoho Forms will have access to this information, which includes name, email address, school and district information, role, and phone number, but only uses it to provide services to Moondrop and is prohibited from using your information for their own business purposes and is prohibited from sharing it with any third party.

SINGLE SIGN-ON

Where such features are available, you can log into our Service using sign-in services such as Microsoft Single Sign-On or Google Sign In. These services will authenticate your identity, provide you the option to share certain personal information (such as your name and email address) with us, and to pre-populate our sign up form.

ACCESS TO PERSONAL INFORMATION

If yours or your child’s personal information changes, or if you no longer desire our Service, and you wish to update or delete yours or your child’s personal information collected from your child or refuse further collection and use of information collected from your child you may contact us at support@moondropapps.com or login to your account and make the updates. We will respond to your access request within a reasonable timeframe.

We will retain yours and your child’s information as long as the accounts are active or as needed to provide services to you or your child. If you wish to cancel either account or request that we no longer use the information to provide services to you or your child, contact us at support@moondropapps.com.

We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

HOW MOONDROP STORES AND PROTECTS INFORMATION

We use commercially reasonable safeguards to preserve the integrity and security of information collected and maintained through the Service and to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, we cannot ensure or warrant the security of any information you provide to us or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed by unauthorized persons.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

HOW LONG MOONDROP RETAINS INFORMATION

We will only keep your information, including any personal information, for as long as necessary to fulfill the purposes for which we collected it, to comply with our legal obligations, or to enforce our legal rights (or as required so others may enforce their legal rights).

Generally, the length of time we keep your information will depend on the type of information and the purpose for which we are processing it. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we are processing it and whether we can achieve those purposes through other means, and any applicable legal requirements.

At the end of the appropriate retention period, we will either delete your information from our systems completely or anonymize it so it can be used without identifying you and so we no longer have the ability to re-associate the anonymized information with you in the future, such as by aggregating the information.
